These Terms of Use constitute a legally binding agreement made between you and Chicken Dash ("we," "us," or "our"), governing your access to and use of the Chicken Dash mobile game and website, including any content, functionality, and services offered on or through our platforms.

By downloading, accessing, or using our game and services, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not access or use our platforms.

• Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

5. Prohibited Uses

You may use our platforms only for lawful purposes and in accordance with these Terms of Use. You agree not to use our platforms:

6. In-Game Purchases

Chicken Dash offers in-game items for purchase with real currency. All purchases are final and non-refundable, except as required by applicable law. We reserve the right to modify, terminate, or restrict access to any content or feature at any time without notice or liability.

Parents and guardians of minor children should monitor their children's use of the game to ensure they do not make unauthorized purchases.

7. User Contributions

Our platforms may contain message boards, chat rooms, personal profiles, forums, bulletin boards, and other interactive features that allow users to post, submit, publish, display, or transmit content or materials to other users or other persons.

Any user contribution you post to the site will be considered non-confidential and non-proprietary. By providing any user contribution on our platforms, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose.

8. Monitoring and Enforcement

We have the right to:

• Take any action with respect to any user contribution that we deem necessary or appropriate in our sole discretion.

• Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of our platforms.
• Terminate or suspend your access to all or part of our platforms for any or no reason, including without limitation, any violation of these Terms of Use.

9. Limited License and Availability

Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our platforms for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to our platforms, content, and intellectual property.

We cannot guarantee that our platforms or any content on them will always be available or be uninterrupted. We may suspend, withdraw, discontinue or change all or any part of our platforms without notice. We will not be liable to you if for any reason our platforms are unavailable at any time or for any period.

10. Disclaimer of Warranties

YOUR USE OF OUR PLATFORMS, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH OUR PLATFORMS IS AT YOUR OWN RISK. OUR PLATFORMS, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH OUR PLATFORMS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

NEITHER CHICKEN DASH NOR ANY PERSON ASSOCIATED WITH CHICKEN DASH MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF OUR PLATFORMS.

11. Limitation of Liability

IN NO EVENT WILL CHICKEN DASH, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR PLATFORMS, ANY WEBSITES LINKED TO THEM, ANY CONTENT ON OUR PLATFORMS OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Governing Law and Jurisdiction

All matters relating to our platforms and these Terms of Use, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of Italy without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or our platforms shall be instituted exclusively in the courts of Milan, Italy, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country.
